Mediation is a way of resolving conflict. A mediator is a person who helps two or more parties to a dispute to resolve their problems by negotiation.
The mediator does not impose a solution and is not a judge or arbitrator. The process is voluntary and confidential. The parties are encouraged and helped to find solutions to their dispute – solutions they may not have considered before agreeing to go to mediation.
Mediation is the 21st Century’s answer to dispute resolution; the disadvantages of litigation as a conventional way of resolving conflict (cost, speed, publicity, enforcement) are replaced by the advantages of a truly negotiated resolution (continuing or mended relationships, non-financial rewards, privacy). Litigation involves winners and losers whereas, at its best, mediation can create a win-win solution.
Victoria Donajgrodzka is now an accredited mediator and has a special interest in promoting alternative dispute resolution generally, and mediation specifically. Workplace disputes lend themselves well to mediation as both sides usually want to move on from the current situation, whether together or apart, and usually the dispute is more than just about money (although money certainly plays a part).
